760  Drug-Free Workplace

I. Purpose

This policy outlines requirements under the Drug Free Workplace Act of 1988. In accordance with this Act, Middle Tennessee State University (MTSU or University) establishes that a drug-free workplace be maintained. The unlawful manufacture, distribution, dispensing, possession, or use of any controlled substance (including prescription drugs) is banned in the workplace. Controlled substances are defined in 21 USCA § 812, and include such things as opium, hallucinogens (like marijuana, mescaline, etc.), cocaine, amphetamines, heroin, and morphine. This policy does not prohibit the lawful use of prescribed drugs which are taken under the care of a healthcare professional.

II. General

Any employee determined to have violated this policy will be terminated immediately, pursuant to the applicable termination procedures. See Policies 851 Disciplinary Policy for Administrative and Classified Personnel, 204 Tenure, and 800 General Personnel.

Additionally, employees are required to notify their supervisor, or Human Resource Services, of any drug convictions for violation of a criminal drug statute occurring in the workplace no later than five (5) days after the conviction. Conviction is defined as a finding of guilt, plea of nolo contendere, or imposition of a sentence by any state or federal judicial body.

MTSU Commercial Driver’s License (CDL) drivers are subject to quarterly random drug testing as required by Federal Department of Transportation regulations.
